These Terms govern your access to and use of the ArtCubeGallery website(s), our APIs, mobile applications (“App”), and any live support, software, tools, features, or functionalities provided in connection with our services. This includes the ability to view, explore, display, and create artworks, as well as to use our tools to directly interact with others for the purpose of minting, purchasing, selling, or transferring artworks on public blockchains.

PLEASE READ THESE TERMS OF SERVICE CAREFULLY, AS THEY CONTAIN IMPORTANT INFORMATION AND AFFECT YOUR LEGAL RIGHTS. As described in Section 16 below, these Terms include a mandatory arbitration agreement and a class action waiver, requiring that all disputes between you and ArtCubeGallery be resolved through individual arbitration rather than in court before a judge or jury. By clicking to accept, signing, and/or using our services, you agree to be bound by these Terms and all terms incorporated herein by reference. If you do not agree to these Terms, you may not access or use the services.

ArtCubeGallery is not a wallet provider, exchange, broker, dealer, financial institution, payment processor, money services business, or creditor. ArtCubeGallery operates as a peer-to-peer Web3 service that enables users to discover artworks and communicate with one another regarding artworks available on public blockchains. We do not have custody or control over any artworks or blockchains you interact with, and we do not execute or facilitate the purchase, exchange, or sale of artworks. To use our services, you must use a compatible third-party wallet that allows you to conduct blockchain transactions.

ArtCubeGallery reserves the right, at its sole discretion, to update or modify these Terms at any time. If material changes are made, we will make reasonable efforts to notify you, such as by posting a notice on the service or updating the “Last Updated” date at the top of these Terms. By continuing to access or use the service after any modifications become effective, you agree to be bound by the revised Terms. It is your responsibility to review these Terms periodically to stay informed of any changes and to ensure that you understand the terms and conditions that apply when you access or use the service.

Accessing the Service

On ArtCubeGallery, your blockchain address serves as your identity, as it does in much of Web3. To use the Service, you must have a blockchain address and a compatible third-party wallet. Your account on the Service (“Account”) will be linked to your blockchain address. You may optionally personalize your ArtCubeGallery profile by adding additional information, such as a profile photo.

ArtCubeGallery assumes no responsibility or liability for your use of any wallet and makes no guarantees regarding compatibility with any specific wallet. You are solely responsible for maintaining the security of your wallet and must never share your wallet credentials or seed phrase with anyone. Ownership

All third-party trademarks, registered trademarks, and product names referenced on the Service or associated with any artworks displayed are the property of their respective owners. Such marks may not be copied, imitated, or used, in whole or in part, without the permission of the applicable rights holder. References to any products, services, or other information do not constitute or imply endorsement, sponsorship, or recommendation by ArtCubeGallery.

License to Access and Use Our Service and Content

Subject to your compliance with these Terms, ArtCubeGallery grants you a limited, non-exclusive, non-transferable, non-sublicensable, and personal license to access and use the Service. Any software, content, or materials made available as part of the Service are provided solely to enable your permitted use of the Service.

This license is non-commercial and does not permit redistribution, assignment, or sublicensing. Any rights related to content linked to or associated with artworks are governed solely by the applicable creator or seller of such artwork.

Third-Party Content, Agreements, and Services

As a peer-to-peer Web3 service, ArtCubeGallery enables users to explore artworks created by third parties and interact with public blockchains. ArtCubeGallery makes no representations or warranties regarding third-party content and is not responsible for verifying the authenticity, legality, or legitimacy of artworks.

Artworks exist on public blockchains and may be bought, sold, or transferred independently of the Service. These Terms govern only your use of the Service itself. Creators and sellers are solely responsible for minting mechanics, mint counts, and any related obligations. ArtCubeGallery may receive service fees but does not set or control creator earnings, gas fees, or transaction costs.

Disclaimers

YOUR USE OF THE SERVICE IS AT YOUR OWN RISK. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. ArtCubeGallery expressly disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

ArtCubeGallery does not guarantee uninterrupted, secure, or error-free operation of the Service and is not responsible for losses resulting from user error, incorrect transactions, unauthorized access, server failures, phishing, malware, or other third-party attacks.

Please refer to our Privacy Policy for information on how we collect, use, and share your data. By using the Service, you consent to the collection, use, and disclosure of your information in accordance with the Privacy Policy.
